Respondent fraudulently convinced a homeowner to allow access to their property for inspection by falsely representing that California Chemical Termite Control had changed its name and was no longer in operation when in fact, the company was still in business. He committed gross negligence or fraud by certifying that property was free of evidence of active infestation when, in fact, it was not; and engaged in the practice of structural pest control without a valid operator's license and without a valid company registration. The revocation was effective June 16, 2000.
In the same matter, the license held by Doyle Leeroy Harwood (FR-24978, Branch 3) was suspended for 15 days and placed on three years' probation. Respondent paid a $1,000 civil penalty in lieu of the 15 days' suspension. The Stipulation also required Respondents to pay restitution to the homeowner in the amount of $18,420 and reimburse the Board for investigative costs in the amount of $4,400. In addition, Respondents must post a $3,000 restoration bond, complete Board approved courses in rules and regulations, business ethics, and Branch 3 termite inspection procedures, and file quarterly reports with the Board. Respondent furnished a Notice of Work Completed and Not Completed prior to the completion of the work specified and failed to report inaccessible portions of the subarea. Also, Respondent was guilty of gross negligence by failing to report evidence of wood-boring beetle damage. The Stipulation was effective May 10, 2000.
The company registration held by L. B. Elms Termite Control (PR-2230, Branch 3) and the operator's license held by Lonnie Benson Elms (OPR-8943, Branch 3) of Santee were revoked as a result of a Default Decision and Order. Respondent failed to report evidence of subterranean termite damage, departed from accepted trade standards for good and workmanlike construction, failed to obtain a building permit prior to commencing work, and failed to post a tag indicating the chemical(s) used to treat subterranean termites. The revocations were effective May 4, 2000.
In the matter of the application for a Branch 3 field representative's license submitted by Larry Greene of Sherman Oaks, the Board adopted the Stipulation which grants the issuance of a license. Green will immediately be placed on three years' probation, required to file a $500 restoration bond and file quarterly reports with the Board. While holding a field representative's license, Respondent committed acts involving dishonesty, fraud, or deceit with the intent to substantially benefit himself. The Stipulation was effective March 15, 2000.
In the matter of the application for the issuance of a Branch 3 operator's license submitted by Ronald C. Roth of Paso Robles, the Board adopted the Stipulated Settlement which reinstated Roth's field representative's license and placed it on three years' probation and subject to the terms and conditions including a requirement that he complete a Branch 3 Board-approved course within the first year of probation. Under the decision, Roth may, after one year of the effective date of the Stipulation, take the examination for operator's license in Branch 3 and, if successful, be eligible for a Branch 3 operator's license. The Branch 3 license would be placed on probation for two years. The Stipulated Settlement was effective February 25, 2000.

Respondents violated the terms and conditions of probation by failing to file quarterly reports, failing to make cost recovery payments, and failing to pay the $125 inspection fee as required in Accusation No. 97-27. The Default Decision was effective February 24, 2000.

Lawson (OPR7708, Branches 1 & 2) both of Placentia paid a $2,500 civil penalty and had to serve an actual five-day suspension. Respondents were also required to reimburse the Board $1,850 for investigative costs. It was determined that respondent failed to properly seal two condominium units to prevent reentry during aeration by using secondary locks that could be bypassed and failed to adequately secure a damaged sliding glass door. Respondent also failed to submit a notice of intent to fumigate with the Los Angeles County Agricultural Commissioner's office. The suspensions were effective November 28, 1999.
In the matter of the application for the issuance of a Branch 3 company registration and operator's license submitted by Natthavudh Matthew Vichaidit of Alhambra, the Board denied the license and company registration application. The applicant falsified a Notice of Transfer of Employment form and attached a false Certificate of Experience to the application in an attempt to meet the experience qualifications. The default decision was effective November 25,1999.
The company registration of E-Z Construction & Termite Control (PR2307, Branch 3) and the license issued to Tracy Dale Ezzell (OPR7981, Branch 3) both of Manteca were revoked. Revocation was stayed, and respondent paid a $2,000 civil penalty. Respondents were placed on three years' probation and required to file a $1,000 restoration bond with the Board. In a stipulated settlement, respondent admitted that cause for discipline existed. The accusation had alleged that respondents had failed to report fungus damage, faulty grade condition, subterranean termite damage, fungus, earth-to-wood contacts, and subterranean termite and damp wood termite damage. Respondent was also required to reimburse the Board for costs in the amount of $2,218.02. It was determined that respondent contracted for and performed pest control work on his own behalf and engaged in the practice of pest control without registering with the Board. The registration certificate of So Cal Exterminator, Inc. dba California West Exterminators (PR2396, Branch 3) and the license of Richard Anthony Mack (OPR9043, Branch 3) both of Norwalk were revoked in a default decision. Respondent failed to report evidence of drywood termite damage, decay, and fungi damage and failed to exterminate all reported wood-destroying pests and organisms. The revocations were effective September 26, 1999.
In the same matter, the license of Richard B. Weekes (FR25679, Branch 3) of La Mirada was revoked in a default decision. The revocation was effective September 26, 1999.
In a stipulated settlement, the license issued to Andrew M. Pauka (FR19979, Branch 2) of Los Gatos was surrendered to the Board. The operator's license OPR9835, Branch 2) was revoked. The revocation was stayed and respondent paid a $2,000 civil penalty in lieu of 30 days' suspension. Respondent had to serve an actual 15 days' suspension. Respondent acted in the capacity of a pest control company when he did not have a valid company registration. Respondent, while a licensee and applicant, solicited pest control work beyond the scope of his field representative's license. The suspension was effective September 16, 1999.
The company registration of Rapid Fire Pest Control (PR1703, Branches 2 & 3), Rapid Fire Termite & Pest Control (PR2973, Branches 2 & 3) and the license issued to James Ray Ridenour, Jr. (OPR8937, Branches 2 & 3) all of Santa Rosa were each revoked in a default decision. It was determined that grounds existed to revoke probation and reimpose the order of revocation in that respondents failed to comply with conditions of their probation. Respondent, as the Qualifying Manager for Diversified, was held responsible when Diversified failed to have two effective masks readily available to its fumigation crew when they were preparing to release or remove a fumigant from a structure. Respondent was also responsible for a check sent by Diversified to the Los Angeles County Agricultural Commissioner's Office for pesticide usage fees, when that check was later returned by the bank due to insufficient funds. In the same matter, the license issued to Brian Anthony Hildbrand (FR24015, Branch 1) of Anaheim was revoked in a default decision. Respondent failed to properly secure the residence against reentry after fumigation and was guilty of the negligent handling or use of Vikane, a poisonous exterminating agent, by not following the label instructions for Vikane. Mr. Harrison is prohibited from serving as an officer, director, associate, partner, qualifying manager, or responsible managing employee of any registered company. Respondent failed to file an inspection report with the Board and failed to report an inaccessible area. Respondent also failed to report conditions conducive to decay fungi infection, earth-to-wood contacts, evidence of decay fungi damage, faulty grade levels and water stains on walls. Respondent misrepresented the condition of the property by reporting no findings of wood-destroying pests or organisms. The default decision was effective August 22, 1999.

Respondent admitted that he did not make the proper recommendations for corrective measures to exterminate drywood termites and did not exterminate the drywood termites. He also fraudulently misrepresented that areas of drywood termite infestation would be treated with the microwave to eliminate the infestation when, in fact, the microwave did not eliminate the infestation. He aided in the advertisement or distribution of material containing false statements concerning use of the microwave as an effective alternative to chemicals, fumigation, or all-encompassing treatment methods for elimination of drywood termite infestation. The suspension was effective July 22, 1999.
In the same matter, the field representative's license issued to Tyler R. Anderson (FR22680, Branch 3) of San Gabriel was placed on probation for two years, required to file a $500 restoration bond with the Board, and complete a Branch 3 Board-approved correspondence course. Respondent failed to exterminate the drywood termite infestation in a garage that extends into inaccessible areas and failed to include information regarding the garage on the completion notice. The decision was effective July 22, 1999.
In the same matter, the field representative's license issued to Stephen Whitson (FR18221, Branch 3) of San Diego was suspended for ten days and placed on probation for two years. Respondent was also required to post a restoration bond in the amount of $1,000. In a stipulation, respondent admitted to making an improper recommendation for corrective measures to exterminate drywood termites and fraudulently misrepresented that areas of drywood termite infestation would be treated with the microwave as required to eliminate the infestation when, in fact, the microwave did not eliminate the infestation. The suspension was effective July 22, 1999.
In the same matter, the operator's license issued to Joseph Peter Serrano (OPR9854, Branch 3) of Sylmar was placed on probation for two years. Respondent was required to complete a Branch 3 Board-approved course and post a $500 restoration bond. Respondent admitted to not providing the homeowner with a written inspection report of the inspection that respondent had performed. The decision was effective July 22, 1999.
The company registration of Six Rivers Termite Control (PR108, Branch 3) and the license of Fred Thomas Walden (OPR5295, Branch 3) both of Santa Rosa were suspended for 90 days and placed on probation for three years. Respondents were required to post a restoration bond for $8,000 and reimburse the Board $5,000 for investigative costs. Walden was required to complete a Board-approved course in Branch 3. It was determined that respondent failed to obtain a permit before commencing repair work on a property and failed to report wood destroying beetles, decay, and subterranean termite damage. Respondent also conducted business without first registering with Humboldt County Agricultural Commissioner's Office and was found grossly negligent by leaving the chemical Dursban TC, Jasco Termite-8 Wood Preservative Green, and a plastic sprayer with Boron unattended and improperly stored. The suspensions were effective July 22, 1999.
The registration held by General Pest Service Company, Inc. (PR1094, Branch 3) and the license issued to Romy Arthur Bergamini (OPR8036, Branch 3), both of Venice, were placed on two years' probation and required to pay a civil penalty in the amount of $1,000. Respondents were also required to complete a Branch 3 Board-approved course, file a $1,000 restoration bond with the Board, and reimburse the Board $4,134.25 for investigative costs. It was determined that on several occasions respondents engaged in the practice of structural pest control without a valid company registration certificate or a valid operator's license in that their licenses had previously been suspended. It was also determined that respondents continued to practice structural pest control without maintaining an insurance policy, failed to file monthly pesticide use reports with the County Agricultural Commissioner's Office, and submitted several inspection and completion reports to the Board using the same stamp numbers. The decision was effective July 22, 1999.
The company registration held by Concepcion Rivas, Inc. dba Mighty Fume (PR2761, Branch 1) and the operator's license held by Michelle Stephenson (OPR9178, Branch 1) both of Bellflower were each suspended for 10 days, stayed, with an actual six days' suspension. Respondent paid a $1,000 civil penalty in lieu of the six days suspension and was placed on probation for two years. Respondent was required to complete a Branch 1 Board-approved course in rules and regulations, and business practices, and to reimburse the Board $2,970.74 for investigative costs. The imposition of discipline was based on the number of repetitive cases where respondent failed to pay the Los Angeles County Agricultural Commissioner's Office applicable fees for fumigations performed in that county, as required by law. The decision was effective July 22, 1999.
The registrations held by Chem Free, Inc. dba Certification Services (PR2161, Branches 1, 2 & 3), Chem Free, Inc. (PR1923, Branches 2 & 3) and the license issued to Daniel Michael Murphy (OPR8336, Branches 2 & 3) all of Long Beach were each placed on two years' probation and required to reimburse the Board $3,813.49 for investigative costs. In a stipulated settlement, respondents admitted that they aided and abetted an unlicensed person to evade provisions of the law by having the unlicensed person serve as a corporate officer even though his operator license was revoked and he was prohibited from serving as an officer, director, associate, etc. for any registered company. The decision was effective July 22, 1999.
In the same matter, a default decision revoked the license held by Kathleen Milburn (OPR8792, Branch 1) of Long Beach. The decision was effective July 23, 1999.
The company registration certificate held by The Termite Inspector, Inc. (PR1599, Branch 3) of Valencia, was revoked in a default decision. It was determined that respondent fraudulently misrepresented that areas of drywood termite infestation would be treated with the microwave as required to eliminate the infestation, when, in fact, the microwave did not eliminate the infestation. Respondent aided in the advertisement of material containing false statements concerning use of the microwave as an effective alternative to use of chemicals, fumigation, or all-encompassing treatment methods, when the microwave is only a local treatment method and not suitable for treating all inaccessible areas. On separate properties respondent failed to report decay fungi, active drywood termites, and subterranean termite damage. Respondent failed to exterminate drywood termite infestations and failed to complete the project for the contract price. The default decision was effective May 19, 1999.
The field representative's license held by Robin Cobb (FR14920, Branch 3) of Miranda was revoked in a default decision. It was determined that respondent was grossly negligent by leaving the chemical Dursban TC, Jasco Termite-8 Wood Preservative Green, and a plastic sprayer with Boron, unattended and improperly stored. Respondent failed to report wood-destroying beetles, decay and subterranean termite damage, and cellulose debris. Respondent also failed to register with the Humboldt County Agricultural Commissioner's Office prior to performing pest control work and doing chemical treatments. The default decision was effective May 12, 1999.
The company registration held by Creative Environmental (PR2930,. Branches 2 & 3) and the operator's license held by Thomas Sorenson (OPR9542, Branches 2 & 3) both of Oakview were each suspended for 15 days and were placed on probation for three years. Respondents were required to reimburse the Board for investigative costs in the amount of $3,155.94, complete a Branch 3 correspondence course within 18 months, and file a $3,000 restoration bond with the Board. Respondents agreed to the imposition of penalty for failing to report several conditions such as cellulose debris, subterranean termite infestation, drywood termite infestation, decay fungi damage, and earth-to-wood contact condition. In addition, respondents did not obtain required building permits and did not perform corrective work as specified in the contract or within the contract price. The suspensions were effective April 18, 1999.
The company registration held by Cedars Termite Control (PR2455, Br.3) and the operator's license issued to Ross Edwin Griffin (OPR4076, Branch 3) both of Oroville were each suspended for 45 days and placed on five years' probation. Respondents were also required to reimburse the Board $2,329 for investigative costs and make restitution to two consumers totaling $7,437. In addition, respondent must complete a Branch 3 correspondence course within two years and must file an $8,000 restoration bond to be maintained during the probation period. In a stipulation, respondent admitted that he had failed to perform a bona fide inspection for wood-destroying pests or organisms prior to providing a report of inspection; failed to file inspection reports with the Board; failed to retain field reports for three years; and failed to bring the property into compliance after receiving two notices from the Board to do so. Respondent also failed to perform in a good and workmanlike manner. Respondent misrepresented the state of the property by certifying it to be free from evidence of active infestation and infection when, in fact, evidence of decay fungi damage was present. On several other properties, respondent failed to report earth-to-wood contacts, evidence of decay fungi damage, cellulose debris, and subterranean termite damage and failed to complete the repair work for the contract price. The suspensions were effective April 18, 1999.

Respondent is required to complete a Board-approved pest control course in Branch 1. Respondent admitted removing tarps from a site without having two effective masks readily available to the fumigation crew when they were preparing to release or remove a fumigant from the structure. The suspension was effective April 21, 1999.
The field representative's license issued to George Zepeda (FR27054, Branch 2) of Escondido was revoked in a stipulated settlement. Acting outside the scope of his license, respondent contracted for pest control work on his own behalf, performed pest control work when he did not possess an operator's license, and represented that pest control work had been complete when, in fact, it was not. The decision was effective April 17, 1999.
The registration held by Stoneridge Termite Control (PR2611, Branch 3) and the operator's license held by Lee Timothy Harris, Jr. (OPR9300, Branch 3) both of Riverside were revoked as a result of a default decision. It was determined that respondents failed to report excessive moisture condition, decay fungi damage, drywood termite damage, and the presence of cellulose debris. Respondent was guilty of gross negligence by failing to report evidence of drywood termites in several locations. Respondent also failed to complete repairs for the contract price. The revocations were effective April 11, 1999.
The field representative's license held by Richard Patrick Lloyd (FR25266, Branch 3) of Oroville was revoked in a default decision. Respondent failed to report inaccessible area, conditions conducive to decay fungi infection, earth-to-wood contacts, and faulty grade levels. Also, respondent misrepresented the condition of the property and issued an inspection report without having first performed a bona fide inspection. The default decision was effective April 2, 1999.

After making a reinspection on the property, respondent misrepresented the conditions found on the property and was negligent by stating the property was free of evidence of active infestation or infection when, in fact, it was not. The operator's license held by Gary Alan Meier (OPR8033) of North Hollywood was suspended for five days and placed on three years' probation. However, Mr. Meier paid a $1,000 civil penalty in lieu of the five days' suspension. A $1,000 restoration bond was also required by the stipulated settlement. Respondent admits that as a qualifying manager, he issued a pest control bid and work authorization contract prior to performing an inspection of several units at a condominium complex. The decision was effective January 28, 1999.
The company registration held by Evans Exterminating Company (PR546, Branches 2 & 3) and the license of Robert Gary Evans (OPR4083, Branches 2 & 3) both of Burbank were placed on probation for three years. The Branch 1 company registration and Branch 1 operator's license was revoked. The stipulated settlement also required respondents to reimburse the Board $9,000 for investigative costs. It was stipulated that the Board had sufficient evidence that respondents failed to adequately prepare and carry out the fumigation by failing to barricade an adjoining garage, post warning signs at the exterior of the guest house, and seal electrical conduits to prevent Methyl Bromide from passing into the guest house, that such negligence proximately caused a death due to Methyl Bromide poisoning, and that multiple state laws and regulations were violated. The decision was effective January 22, 1999.
In the same matter, the license issued to Jesus Santana (FR25087, Branch 1) of Burbank was revoked. If respondent should apply for a Branch 2 or 3 field representative's license, said license would immediately be placed on three years' probation. The decision was effective January 22, 1999.

However, a civil penalty in the amount of $2,500 was paid in lieu of 30 days and respondent served an actual 15 days' suspension. The stipulation also placed respondent on three years' probation, required completion of a Board-approved course in structural pest control, and required respondent to file a $3,000 restoration bond with the Board. Respondent solicited for pest control work, submitted a written estimate, and advertised as a pest control company without first registering his company with the Board. Respondent also failed to provide the property owner with a clear written statement concerning the pesticide(s) to be used and the active ingredient(s). The decision was effective January 21, 1999.
In the matter of an application received for a field representative's license in Branches 2 & 3 submitted by Lloyd P. Dorris of Petaluma, the stipulated agreement was to grant the issuance of the license contingent upon respondent fully complying with the requirements for issuance of said license. Said license would then immediately be placed on two years' probation and the licensee required to complete a Branch 3 correspondence course and file a $6,000 restoration bond with the Board. The decision was effective on January 21, 1999.
The company registration held by J. H. Steffenson Termite & Pest Control, Inc. dba Allied Fumigation (PR415, Branches 1, 2 & 3), the company registration held by J. H. Steffenson Termite & Pest Control, Inc. dba Ms. Mouse Pest Control (PR385, Branches 2 & 3), the license issued to Scott Steffenson (OPR9015, Branch 1) and the license issued to James Harvey Steffenson (OPR8546, Branches 2 & 3), all of Campbell, were suspended for three days. The stipulated settlement placed each respondent on 18 months' probation. Respondents had failed to use adequate warning agent (chloropicrin) while performing a fumigation. The decision was effective January 20, 1999.
In the same matter, the license issued to Rick Lee Young (FR25182, Branch 1) of Campbell was revoked in a default decision. The revocation was effective January 9, 1999.
The company registration held by Sunrise Pest Control (PR1702, Branches 2 & 3) and the operator's license held by Robert Oliver Richardson (OPR 8417, Branches 2 & 3), both of Carmichael, were suspended for five days. However, a civil penalty in the amount of $1,000 was paid in lieu of suspension and respondents were placed on a three-year probation. Respondents were also required to pay restitution to the consumer in the amount of $4,000, reimburse the Board for investigative costs of $1,500, and complete a Board-approved course in Branch 3. In the stipulated settlement, respondents admitted that recommended repairs were not completed and that they had failed to bring the property into compliance within 30 days as ordered by the Board. They also misrepresented the condition of the property by certifying it to be free from active infestation and/or infection when, in fact, infections of decay fungi, damage, and moisture conditions still existed. The decision was effective January 20, 1999.
In the matter of the application for the issuance of a Branch 1 operator's license submitted by Kenneth John Campion of Spring Valley, the Board adopted the Administrative Law Judge's proposed decision to deny the license application. Respondent was the owner of Corky's Fumigation, which violated numerous provisions of the Structural Pest Control Act and the Food and Agricultural Code between July 1992 and December 1992, including the use of a tarp with large holes permitting fumigant to leak, using a fumigant in a manner contrary to the instructions on the product's label, and failing to properly secure buildings being fumigated. In addition, respondent aided and abetted an unregistered company in evading provisions of the Structural Pest Control Act by allowing the unregistered company to use the address, telephone number, and property of Corky's Fumigation in order to perform several fumigations in San Diego County. Sufficient rehabilitation was not established to protect the public safety. The decision was effective January 17, 1999.
1998
The field representative's license issued to Scott Silao (FR22630, Branch 1) was revoked in a default decision. The decision reimposed the order of revocation because respondent failed to comply with terms and conditions of the probation in a prior disciplinary matter. Respondent performed the duties of a field representative during the period when he did not have the required restoration bond on file with the Board, and he failed to file the required quarterly reports with the Board. The decision was effective December 31, 1998.
The registration held by Sentinel Termite & Pest Control (PR1593, Branches 2 & 3) and the licenses issued to Dale Glenn Fisher (OPR9317, Branch 3) and Daniel Lee Bussey (OPR8604, Branch 2), all of Corona, were revoked in a default decision. It was determined that respondents had acts of gross negligence by failing to report wood-destroying pest and/or organisms on several occasions. It was also determined that respondents misrepresented that a property was free of evidence of active infestations or infections when, in fact, active infestations and infections were still clearly visible after completion of repairs. The decisions were effective November 13, 1998.
The registration held by Paramount Pest Control Service of Los Angeles (PR1068, Branches 2 & 3) and the license issued to James Royster Hinton (OPR4902, Branches 2 & 3), both of Los Angeles, were revoked. However, the revocations were stayed with a concurrent 15-day suspension for respondents. Respondents elected the option of paying a civil penalty in the amount of $1,400 in lieu of a seven-day suspension. Therefore, respondents served an eight-day suspension and were placed on probation for three years. Respondents were also ordered to post a disciplinary bond in the amount of $4,000, pay $3,600 restitution to the consumer, reimburse the Board $3,500 for the cost of the suit and complete a Board-approved correspondence course in structural pest control repairs and corrections. In a stipulated settlement, respondents admitted that they failed to report evidence of wood-destroying pest and/or organisms, failed to report evidence of wood-destroying pests, which extended into an inaccessible area, and failed to make a recommendation thereof. Respondents failed to notify homeowners of pesticide or pesticides to be used and also failed to include this information on the inspection report. They misrepresented that property was free of evidence of active infestation or infection when, in fact, the infestation had not been eliminated, and they failed to complete repairs within the contracted price. The decision was effective November 11, 1998.
The registration held by Tallon Termite and Pest Control, Inc. (PR545, Branch 3) of Long Beach and the branch office of Tallon Termite and Pest Control, Inc. (BR3889, Branch 2) of Redondo Beach were suspended for 15 days. However, a civil penalty in the amount of $5,000 was paid in lieu of 13 days of the suspension, leaving respondents to serve an actual two-day suspension and complete two years of probation. The license issued to Joseph Frederick Tallon (OPR7788, Branch 3) of Long Beach and the branch offices of Tallon Termite and Pest Control, Inc. (BR3800, BR4195, BR4273, BR4376, and BR4393, all in Branch 2) of Bakersfield, Lemon Grove, Union City, Ventura, and Watsonville, respectively, were suspended for 15 days. However, these suspensions were stayed and respondents were placed on probation for two years. Respondents are required to complete a Board-approved correspondence course in structural pest control and pay restitution to three consumers in the amounts of $14,000, $30,000, and $1,000. Respondents are also required to reimburse the Board $15,365 for cost of this case and post a surety bond with the Board. The accusation had alleged that the respondents had failed to eradicate wood-destroying pest and/or organisms as required by a contractual service agreement with a consumer, failed to report areas of wood-destroying pests and/or organisms, failed to report inaccessible areas and make recommendations thereof, and misrepresented that they had completed the corrective work when, in fact, they had not. It was also alleged that work, which was performed, did not meet the accepted trade standards for good and workmanlike construction. Although the respondents did not specifically admit to any of the allegations set forth in the accusation, respondents acknowledged that the Board had a sufficient evidentiary basis to initiate administrative action to impose discipline. The decision was effective November 11, 1998.
In the same matter, all charges against Robert W. Trout were withdrawn, effective October 7, 1998.
The registration held by Allstate Exterminating (PR461, Branch 3) and the license issued to Neal Raymond Rinaldi (OPR4559, Branch 3), both of Malibu, were revoked in a default decision. It was determined that respondents had failed to adhere to the terms of their probation as stipulated in a settlement agreement in that respondents had failed to pay restitution to a consumer and failed to file quarterly reports with the Board. The decision was effective September 24, 1998.
The registration held by Bonita Pest Control (PR321, Branches 2 & 3) of Bonita and the license issued to Jack Harrison Cooper (OPR7629, Branches 2 & 3) of La Jolla were both revoked in a default decision. It was determined that respondents had failed to adhere to the terms of their probation by failing to pay restitution to a consumer, failing to reimburse the Board for the cost associated with their case, and failing to post a restoration bond. The decision was effective September 10, 1998.
The licenses issued to Antonio F. Buitron (FR19124, Branch 3) of Gardena and Robert Arbizo (FR20701, Branch 3) of Lakewood were revoked in a default decision for failing to report evidence of wood-destroying pests and/or organisms and for failing to report inaccessible areas and make a recommendation thereof. The revocations were effective August 29, 1998.
The field representative license issued to Natthavudh Matthew Vichaidit (FR21513, Branch 3) of San Gabriel was revoked in a default decision. It was determined that respondent, in an attempt to meet experience requirements for an operator, falsely completed and signed a Certificate of Experience. The decision was effective August 2, 1998.
The registration held by Mitchell Hall Termite Control (PR2158, Branch 3) and the license issued to Mitchell L. Hall (OPR8878, Branch 3) of Fair Oaks were revoked. The revocations were stayed with a 20-day suspension. Respondents were already serving a three-year probation, which began on July 1, 1997, for a prior disciplinary action. Respondents were ordered to serve an additional two-year probation period to commence upon completion of original probation. They were also ordered to pay $12,125 restitution to the consumer, post a restitution bond in the amount of $4,000 to be maintained during the entire probation. Respondents admitted that they had failed to report several areas of wood-destroying pests and/or organisms, to report earth to wood contacts, to report inaccessible areas, and to make recommendations thereof. Respondents also misrepresented that all work had been completed and that the property was free of evidence of active infestation and/or infection when, in fact, it was not. The decision was effective August 1, 1998.
In the same matter, the license issued to Jeffrey L. Daniels (FR25770, Branch 3) of Fair Oaks was revoked. The revocation was stayed and respondent's license was suspended for ten days and placed on three years' probation. Respondent must also complete a Board approved correspondence course in structural pest control. The decision was effective August 1, 1998.
The company registration held by King Termite Control, Inc. (PR839, Branch 3) and the license issued to Kenneth Allen Downie (OPR 9049, Branch 3) and Jerald Keith Downie (OPR 6347, Branch 3) all of Burbank were suspended for 30 days. However, a civil penalty of $4,000 was paid in lieu of 20 days of suspension; therefore, respondents served an actual ten-day suspension and were placed on probation for three years. Respondents were required to reimburse the Board $2,600 for costs of this case and complete a Board-approved correspondence course. In a stipulated settlement, the respondents admitted that they had failed to report areas of wood-destroying pests and/or organisms that extended into inaccessible areas and failed to make recommendations regarding the inaccessible areas. They also failed to report other areas of wood-destroying pests and/or organisms and earth-to-wood contacts. Respondents falsely represented that all repairs were completed and that property was free of evidence of active infestation and/or infection when, in fact, the active infestation had not been eliminated. Repairs were also not completed within the contracted price. The decision was effective July 30, 1998.
In the same matter, the license issued to Peter D. Pontrelli (FR21656, Branch 3) of Burbank was revoked. The revocation was stayed with five days' actual suspension and respondent was placed on three years' probation. Respondent was also, required to complete a Board-approved correspondence course in structural pest control. The decision was effective July 30, 1998.
The company registrations held by Terminix Int. Company (PR801, Branches 1, 2 & 3) of San Francisco and Sacramento, along with the license issued to Lee Zusman (OPR7789, Branches 1, 2 & 3) of San Francisco, were placed on probation for seven months and the licensees were ordered to pay restitution of $5,605 to the consumer. It was determined that respondents failed to report areas of wood-destroying pest and organisms and misrepresented that all repairs had been completed and the property rendered free of evidence of active infestation and/or infection when, in fact, it was not. The decision was effective July 9, 1998.
In the same matter, the license issued to Robert M. Dorsey (FR24172, Branches 2 & 3) of Sacramento was revoked effective July 9, 1998.
The charges filed against Nicolas O. Anding (FR 19998, Branches 2 & 3) of Newport Beach were dismissed effective July 9, 1998.
The license issued to Curtis Scott Harmon (OPR9249, Branch 2) as qualifying manager for Pestnet Corporation, of Rancho Cordova was revoked. It was determined that an employee of Pestnet Corportation failed to perform pest control in a careful and safe manner. This resulted in exposure to and ingestion of a pesticide by a child. It was also determined that respondent failed to report the use of a pesticide to the County Agricultural Commissioner's Office. The revocations were effective July 30, 1998. Pestnet Corportation (PR2567, Branch 2) had previously canceled its Branch 2 license in March 1997.
In the same matter, following a default decision, the applicator and field representative licenses issued to Justin Daniel Roberts, also known as Justin Mark Roberts (RA35810, Branch 2, RA35809, Branch 3, and FR27169, Branch 2) of Sacramento were revoked. The revocations were effective June 21, 1998.
The registration held by Stotelmyre Professional Pest Control (PR 77 - Branches 1, 2 & 3) and the license issued to Lyle M. Stotelmyre (OPR 6316 - Branches 1, 2 & 3) of San Bernardino were suspended for 15 days and placed on probation for three years. Respondents were required to reimburse the Board $5,845 for costs of this case and complete the UCB correspondence course. In a stipulation, respondents admitted they had failed to report wood-destroying pests and/or organisms, failed to report inaccessible areas and did not make recommendations regarding those areas, failed to provide homeowner with copy of inspection report within ten days and started construction prior to homeowner being given copy of report. They also misrepresented that repairs had been completed and property was free of evidence of active infestation and/or infection and falsely charged and collected for work not completed. The suspension was effective April 19, 1998.
In the matter of an application for a field representative license received from Roberto Barajas, the Board denied this application based on the respondent's history of criminal activity. This decision was effective April 19, 1998.
The registration held by ABC Exterminators (PR 2059 - Branches 2 & 3) and the license issued to Gerardo Muro (OPR 8576 - Branches 2 & 3) of El Centro were suspended for 90 days and placed on probation for three years; 60 days of this suspension was stayed. Respondents were required to complete the remaining 30 days of suspension. Respondents were also required to reimburse the Board $3,281 for costs of this case and provide the Board with proof that all reports are filed timely with the Board and that employees have received proper training in the handling and use of pesticides. It was determined that respondents failed to file monthly pesticide use reports, failed to properly label containers containing pesticides, failed to provide required training of pesticide use and handling to employees, and failed to provide a proper onsite changing area. They also applied pesticides prior to notification to the County Agricultural Commissioner's office and used pesticides not registered in the state of California. The suspensions were effective April 19, 1998.
The registration held by Gold Rush Termite Company (PR 29 - Branch 3) and the license issued to Donald Gene Pannell (OPR 5139 - Branch 3) of Placerville were revoked. Respondents were ordered to reimburse the Board $1,200 for costs of the case and are restricted from applying for a company registration or license for two years. In a stipulation, they admitted they had failed to report wood-destroying pests and/or organisms, failed to include the required roof statement on the inspection report, failed to identify pesticide or pesticides being recommended to homeowner, and failed to provide homeowner with the telephone numbers to the local poison control center and the Board in case of pesticide incident or accident. The revocation was effective February 25, 1998.
The Accusation filed against Gen-Tech Inspections, Inc. and against Daniel Marzilli of Oakland were dismissed effective February 25, 1998.
In the matter of the application for an unrestricted field representative license received from James Robert Berzinski, the Board denied the request due to a past history of criminal activity. However, respondent did demonstrate that he was rehabilitated, and a probationary field representative license was granted. The probationary period is three years, during which time respondent must file quarterly reports with the Board. This decision was effective February 25, 1998.

The license issued to Richard Douglas Jones (FR 7764 - Branch 1) of Fullerton was revoked in a default decision for failing to adequately lock, barricade, or otherwise secure properties from reentry after a Vikane fumigation. The revocation was effective November 29, 1997.
The license issued to Stephen Aloysius Scholl (FR 16678 - Branch 3) of Simi Valley was revoked. In a stipulation, respondent admitted that he had contracted for and performed pest control work on his own behalf without a company registration while employed by a pest control company as a field representative. Respondent also admitted that he had not met accepted standards of good and workmanlike construction. The revocation was effective November 27, 1997.
The registration held by Absolute Termite Control (PR 2079 - Branch 3), owned by Ronald Bates of Fountain Valley, the license issued to William Edward Dagsher (OPR 9318 - Branch 3) of Anaheim, and the license issued to Craig Alan Ruff (FR 24097 - Branch 3) of Fountain Valley were revoked in a default decision for issuing a bid and contracting for work prior to completion of an inspection report. When an inspection report was completed, respondents failed to report areas of wood-destroying pests and/or organisms, failed to file reports within ten days with the Board, failed to exterminate pests, failed to complete repairs for the contracted price, and misrepresented that repairs had been completed and property was free of evidence of active infestation and/or infection. The decision was effective November 20, 1997.
The license issued to Steve Casey (FR 22269 - Branch 2 & 3) of Bakersfield, was revoked. In a stipulation, he admitted to soliciting and performing pest control work on his own behalf without a valid license to do so, while employed by a pest control company. The revocation was effective November 9, 1997.
The company registration held by Deal Termite Company (PR 2309 - Branch 3) and the license issued to Dane Jeffrey Deal (OPR 9005 - Branch 3) of Santee were suspended for 14 days and placed on three years' probation. Respondents were required to reimburse the consumer $15,000 and reimburse the Board $1,500 for costs of this case. Respondents admitted that they failed to report wood-destroying pests and/or organisms, failed to indicate inaccessible areas, failed to exterminate the pests, misrepresented that work had been completed and property was free of evidence of active infestation and/or infection, and failed to file reports within five days with the Board. Respondents also admitted that they had not met trade standards for good and workmanlike construction and were unable to complete the repairs within the contracted price. The suspensions were effective November 9, 1997.
In the same matter, the Branch 3 license issued to Brion A. Deal (FR12922 - Branch 3) of Santee was revoked. The Branch 1 & 2 license issued to Deal were suspended for seven days and placed on probation for three years. The effective date of this action was November 9, 1997.
In a default decision, the application from Rudolfo E. Valdez for a field representative license was denied. It was determined that respondent had a history of criminal activity and in order to protect public's safety, this applicant was denied. The decision was effective November 7, 1997.
The company registration held by Rapid Fire Pest Control (PR 1703 - Branches 2 & 3) and the license issued to James Ray Ridenour, Junior (OPR8937 - Branches 2 & 3) of Santa Rosa, were suspended for 90 days and placed on probation for three years. The respondents were also ordered to reimburse the Board $14,556 for costs of this case. It was determined that respondents failed to report areas of wood-destroying pests and organisms, failed to indicate that the inspection report was a limited report due to inaccessible areas, and failed to make recommendations regarding the inaccessible areas. They also performed Branch 3, structural pest control work, without a qualifying manager; applied herbicides and pesticides without a license from the Food and Agricultural Department; failed to notify the homeowner of the chemicals being used; and failed to register chemicals or file monthly pesticide use reports with the County Agricultural Commissioner's Office. Several regulation violations were cited regarding labeling and storage of chemicals, in addition to violations governing the training of employees who handle and use pesticides. The suspensions were effective November 15, 1997.
In the same matter, following a default decision, the license issued to George A. Davenport (OPR 7377 - Branch 3) of Oakland was revoked. The revocation was effective November 15, 1997.
The applicator license issued to Jorge Humberto Lepley (RA 4807 - Branch 2) of North Hollywood and Whittier was suspended for 30 days and placed on probation for three years. Respondent was also required to pay restitution of $530 to the consumer. It was determined that respondent had operated a pest control company without an operator's license and without a company registration. He also applied pesticides without keeping records of such applications, did not file monthly pesticide use reports with the County Agricultural Commissioner's Office, and did not purchase or use pesticide use stamps. The suspension was effective November 6, 1997.
The company registration held by Ramsar Inc., dba Shamrock Exterminating Company (PR 1506 - Branches 2 & 3) and the license issued to Robert Lee Mack (OPR 4747 - Branch 3) Norwalk were revoked. It was determined that respondents engaged in pest control work without insurance, violated regulations regarding the application of chemical poisons, failed to remove infestation, failed to bring property into compliance within 30 days as ordered by the Board, and failed to complete repairs within the contracted price. The decision was effective August 23, 1997.
In the same matter, the license issued to Robert Hayden Harns (OPR 6533 - Branches 2 & 3) of Norwalk was suspended for 60 days and placed on probation for three years. All three respondents were required to reimburse the Board $4,515 for costs of this case. The effective date of this decision was August 23, 1997.
The company registration held by Remadee Pest Control (PR 2741 - Branches 2 & 3) of Turlock was suspended for five days and placed on probation for three years. Respondent is required to reimburse the Board $3,000 for costs of this case and pay restitution of $15,195 to the consumer. In a stipulation, respondent admitted that it had failed to report infestations and/or infections which were evident in the structure and had failed to meet accepted trade standards for good and workmanlike construction in performing corrective measures. The decision was effective November 16, 1997.
In the same matter, the license issued to Jesse Donald Boswell (OPR 9402 - Branches 2 & 3) of Turlock was revoked. In a stipulation, he admitted to failing to report areas of wood-destroying pest and organisms, misrepresented that repairs were completed and property was free of evidence of active infestation and/or infection, and agreed he had not met accepted standards of good and workmanlike construction. The decision was effective August 10, 1997.
The registration held by Central Cal Pest Control, Inc. (PR 522 - Branches 2 & 3), Central Cal Pest Control, Inc., dba Oakhurst Pest Control (PR 787 - Branches 2 & 3) and the license issued to Jonathan P. Munro (OPR 8521 - Branches 2 & 3) of Fresno were suspended for 60 days; however, a civil penalty of $6,000 was paid in lieu of 30 days of suspension; therefore, respondents served an actual 30-day suspension and were placed on three years' probation. Respondent Munro shall complete the UCB correspondence course and reimburse the Board $2,234 for costs of this case. In the decision, respondents admitted that in completing an inspection report, they had failed to report items of wood-destroying pests and organisms and misrepresented that all repairs were completed and that property was free of evidence of active infestation and/or infection when, in fact, repairs had not been completed. It was also noted that respondents were unable to complete repairs within the contracted price. The suspensions were effective August 10, 1997.
The registration and branch registration held by So. CAL Exterminators, Inc. dba California West Exterminators (PR 2396 & BR 4528 - Branch 3) of Norwalk and Goleta, and the license issued to Richard Anthony Mack (OPR 9043 - Branch 3) of Norwalk were suspended for ten days. However, a civil penalty in the amount of $1,500 was paid in lieu of seven days of the suspension, leaving respondent to serve an actual three-day suspension and complete three years of probation. The company was also ordered to pay $1,000 restitution to the consumer and reimburse the Board $2,500 for costs of this case. In a stipulated settlement, the respondents admitted that an inspection report on a property failed to include a recommendation for treatment of subterranean termites, even though respondents later performed such work, that a homeowner was not provided with information regarding the pesticide or pesticides to be used, construction work completed did not meet acceptable trade standards for good and workmanlike construction, and work was not completed within the contract price. Respondents also misrepresented that corrective work had been completed and that property was free of evidence of active infestation and/or infection when the work had not yet been completed. The suspensions were effective August 8, 1997.
In the same matter, the license issued to Bill Ray Elvidge (OPR 8748 - Branch 3) of Cerritos was suspended for 30 days. He was also put on probation for three years and required to complete the UCB correspondence course. The license issued to Duane Mark Bushner (FR 11610 - Branch 3) of Norwalk, was suspended for five days. He was put on probation for three years and required to complete the UCB correspondence course. The suspensions were effective August 8, 1997.
In the same matter, the registration held by Sentry Pest Control (PR 2668 - Branch 2) and the license issued to Michael D. Wilson (OPR 7829 - Branch 2) of Madera, were revoked, and respondent Wilson was ordered to reimburse $1,300 to the Board for costs of this case. In a stipulated settlement, respondent Wilson admitted to aiding and abetting Paul Raymond DePalma in his unlicensed advertisement and structural pest control activity and in doing so evaded the provisions of the Structural Pest Control Act. The decision was effective August 8 1997.
The license issued to Paul Raymond DePalma (FR 20101 - Branch 2) of Turlock was suspended for 25 days. He was also placed on probation for three years and ordered to complete the UCB correspondence course. In a stipulation, he admitted that he had advertised as a registered pest control company and contracted for or performed pest control work on his own behalf without a company registration while employed by another company. The decision was effective August 8, 1997.
In the matter of the application for a field representative license submitted by Patrick Lynn Keifer of San Gabriel, an Administrative Law Judge upheld the Board's decision to deny the license application. Respondent had a history of criminal activity, and insufficient time had passed to ensure that respondent was adequately rehabilitated to protect the public's safety if he were to be granted a license. The decision was effective August 8, 1997.
The registration held by Rodent and Insect Detective - RID (PR 2717 - Branch 2) and the license issued to John Christopher Atkinson (OPR 9394 - Branch 2) of Yuba City were suspended for ten days and placed on three years' probation. Respondents will also reimburse the Board $1,533 for costs of this case and complete the UCB correspondence course. It was determined that respondents were guilty of fraudulent advertisement by using a business name on respondent's company vehicle, business cards, and flyers that was not the same as that set forth in its company registration. The suspensions were effective August 7, 1997.
The registration held by Dana's Pest and Termite Control, Inc. (PR 891 - Branch 2 & 3) of Madera, the registration held by Howard's Pest Control Corporation (PR 645 - Branch 2 & 3) of Fresno, and the license held by Howard Merle Gatlin (OPR 7875 - Branch 3) of Fresno were suspended for ten days; however, the suspension was waived upon payment of a civil penalty of $2,000, and respondents were put on probation for three years. Respondents are required to complete the UCB correspondence course and jointly reimburse the Board $3,489 for costs of this case. Respondents are required to submit proof of completion of all repairs directed by the Board. In a stipulation, the respondents admitted that they had failed to report several areas of wood-destroying pests and organisms, violated several provisions of the 1991 Uniform Building Code, failed to meet standards of good and workmanlike construction, filed a notice of work completed prior to completion of repairs, and misrepresented that property was free of evidence of active infestation and/or infection when, in fact, it was not. In the same matter, Dana's Pest and Termite Control, Inc. also failed to: remove wood debris, eliminate earth-to-wood contacts, complete repairs and/or replacement of damaged materials, and failed to complete repairs within the contracted price. The decision was effective on August 7, 1997.
The registration held by Lance Termite Control, Inc. (PR 1211 - Branch 3) and the license held by Leonard Geul (OPR 8579 - Branch 3) of San Mateo were suspended for seven days and put on probation for three years with the following terms and conditions: respondent shall reimburse $4,082 to the consumer, reimburse the Board $2,700 for cost of this case, and complete the correspondence course with UCB. In a stipulation, respondent admitted to failing to prepare a proper written inspection report indicating evidence of wood-destroying pests and/or organisms and misrepresented that the recommended work from a secondary report had been performed and that the property was free of evidence of active infestation and/or infection. The suspension was effective August 2, 1997.
In the same matter all charges alleged against Mike Geul, (FR 21679 - Branch 3) were dismissed. In the matter of Gold Country Structural Pest Control, Inc., (PR 2341 - Branch 3) and the license issued to Richard Allen Stikes, (OPR 6264 - Branch 3) of Grass Valley, both the registration and license were suspended for 60 days and placed on probation for three years; however, a civil penalty of $1,500 was paid in lieu of 15 days of actual suspension, requiring 45 remaining days of the suspension to be served. In the stipulation, the parties admitted that they had failed to report conditions of wood-destroying pests and/or organisms, performed work which did not meet standards of good and workmanlike construction, and misrepresented that corrective work had been completed and that the property was free of active infection or infestation. The suspension was effective August 2, 1997.
The registration and branch registration held by Nature's Way Pest Control (PR 2213 & BR 4392 - Branch 3) and the licenses issued to Daniel Saucedo (OPR 8824 - Branch 3), Daniel Darren Saucedo (Junior) (FR 19766 - Branch 3) and Victor Saucedo (FR 22227 - Branch 3), all of La Puente, were revoked in a default decision. It was determined that respondents failed to report evidence of wood-destroying pests and/or organisms, failed to file reports with the Board within ten days, failed to include information regarding pesticide or pesticides to be used, and failed to provide this information to the property owner. Respondents misrepresented properties to be free of active infestation or infection when they were not. Respondents also had not met acceptable trade standards for good and workmanlike construction, failed to complete repairs within contract price, failed to bring property into compliance within the written 30 days provided by the Board, practiced pest control without a valid company registration, and failed to maintain the required insurance and/or bond. The revocations were effective July 30, 1997.
The license issued to William James Tocki (FR 23479 - Branch 1) of Signal Hill, was revoked in a default decision for failing to use a warning agent when fumigating with Vikane, failing to secure secondary locks on all entries of the structure being fumigated, and failing to supervise during the time ventilation was commenced. The revocation was effective July 17, 1997.
The registration held by Mitchell Hall Termite Control (PR 2158 - Branch 3) and the licenses issued to Mitchell L. Hall (OPR 8878 - Branch 3 & FR 13489 - Branch 2) of Carmichael, were suspended for 15 days, placed on probation for three years, and ordered to reimburse the Board $3,000 for the costs of this case. In a stipulation, the respondents admitted that on several occasions they had failed to file reports with the Board within five days, failed to affix inspection and/or completion stamps to these reports, and had used the same stamp number on different reports. Respondents also admitted that they had not met accepted trade standards for good and workmanlike construction, had disregarded plans or specifications in reference to repairs, had violated sections of the Uniform Building Code, and had not completed repairs within the contract price. The suspension was effective July 1, 1997.
